Bad Check Laws In Idaho

Below are the civil and criminal penalties for writing a bad check in Idaho under Code Sections 18-3106 and 28-3-104, 28-22-105, 28-22-106.

Dishonored checks plus fees must be paid within fifteen days after the holder of such check sends such notice of dishonor or the following may apply:

Civil Penalties: $100 or triple the amount of the check, whichever is greater, but not more than $500 greater than the amount of the check.

Criminal Penalties: A single bad check or a series of dishonored checks in the amount of two hundred fifty dollars or more is punishable as a felony that can result in imprisonment in the state prison for a term not to exceed three years, or by a fine not to exceed fifty thousand dollars, or by both. Amount of less than two hundred fifty dollars is considered a misdemeanor for the first offense (First conviction is punished by imprisonment in the county jail for a term not exceeding six months, or by a fine not exceeding one thousand dollars,or by both.) and second offense (A second conviction shall be punished by imprisonment in the county jail for a term not exceeding one year, or by a fine not exceeding two thousand dollars, or by both ). A third offense for passing a bad check under $250 is a felony and the person so convicted shall be punished by imprisonment in the state prison for a term not exceeding three years, or by a fine not exceeding fifty thousand dollars, or by both.
